How can a ID thief use my torn up credit card application?

If the ID thief does not have my Social Security, how can he submit a credit card application on my behalf? If they have my SS#, they can go online and apply for a credit card anyway. Am I missing something?

Credit application queries within banks in Australia?

Am I likely to be accepted for this loan?

Hi,

I applied online for a loan last week, with a company offering an immediate response/decision.

I filled in the online application & at the end it said that I had been ‘conditionally accepted’ at a higher-than-advertised interest rate (which I was still happy with, as I know my credit rating needs improvement).

They posted two Consumer Credit agreements to me, I signed both & returned one, along with two suitable proofs of address.

However, the day after I was conditionally accepted for this loan, I stupidly applied for another (I was worried that the other one still might not work out) – & I was rejected!

Will this affect my first application? I’m really worried as I desperately need this money & I’m pretty sure that no other companies will give me a loan!

Additional info – I only sent back one copy of the credit agreement as the other is for me to keep.

What I basically wanted to know is, how likely is it that the first company will turn me down, after conditionally accepting me, taking my bank details, sending credit agreements out to me, & asking me to provide them with proof of my address? Are they likely to check my credit history again & see that I have applied for another loan?

I’ve called the company who conditionally offered me the loan for the past two days…yesterday they didn’t know whether the relevant department had received my paperwork back, today the guy I spoke to tried to call that department but couldn’t get through & said he’ll give me a call back once he’s spoken to them…hopefully he will!

I’m based in the UK, so I dunno if being accepted for loans maybe works differently here to in the US? I need the money as I’m coming to the end of my degree, which has been a complete waste of time & cost me a fortune, I need to consolidate all the debt I’ve incurred & move on with my life!

Assistance with car loans?

One person has been paying on it, but I am thinking about trying something, because my parents have offered their old car to me. If I were to sell both cars, I know I will have balances left on the car loans, but at least they will be less than they are now. Is it possible to either a) negotiate with the finance companies to get lower monthly payments or b) go into some sort of ‘debt consolidation’ plan with these “lesser” loans? I’d gotten the notion car loans were secured loans, and therefore organizations like Consumer Credit Counseling would not be able to help with them.

On another similar topic, is there any sort of financial assistance available to people in this sort of situation?

How did consumer credit counselors become a mandatory part of the bankruptcy process?

In 2005, it became the law in the United States that before a person could file for bankruptcy protection, they needed to complete consumer credit counseling.

I am very interested in reading a case study about how they (the consumer credit counseling industry) pulled this off. I have a cursory understanding of the issue – the arguments, the changes to non-profit status, etc… so I don’t want just some high level, overview. I am much more interested in the steps and arguments they used to accomplish this.

The lender has to send any information it holds on the debtor within a period of 40 days or it has committed a criminal offence. If the lender cannot provide a copy of the actual, signed credit agreement they aren’t in a position to enforce the debt as it is an illegal credit card agreement.

Will This Have a Negative Impact on Credit Ratings?

Provided payments are kept up during the legal challenge, no credit rating will be affected. Those who have adverse credit could actually improve their credit rating. This is because the debt was deemed to have never technically existed so no adverse credit entries can be registered for a debt that doesn’t exist. These entries can be removed when a case is successful.

How Long Will it be Before the Outcome?

The duration of any case does vary depending upon the institution and complexity of the case. Most cases are usually settled within 3 to 9 months, sometimes a lot sooner.

What Happens if the Unlawful Credit Card Agreement Case is Successful?

If it is decided that there is an illegal credit agreement, it is possible that the entire debt will be written off. This will mean that the balance is completely wiped and the solicitor will be able to advise how to get any adverse credit entries removed in relation to the debt.

What About Credit Card Debt that Cannot be Written Off?

For more recent credit card debts that cannot be written off, it is worthwhile considering a Debt Management Plan or even an Individual Voluntary Arrangement (IVA). It is imperative the serious debt problems are dealt with as efficiently as possible.

Whilst technically possible to handle the case personally, most financial institutions are unlikely to take any case seriously without the threat of legal action. A Solicitor will assess any agreement and put together a breakdown of any transgressions. Should they feel that it is an unenforceable credit card agreements, everything will be handled by them.
