<p>What is the National Credit Act?</p>
<p>The purposes of the NCA is to promote and advance the social and economic welfare of South Africans, promote a fair, transparent, competitive, sustainable, responsible, efficient, effective and accessible credit market and industry, and to protect consumers. The Act establishes a National Credit Regulator, to carry out education, research, policy development, registration of industry participants, investigate serious complaints, and ensure enforcement of the Act.</p>
<p>What is the National Credit Regulator?</p>
<p>The NCR was established as the regulator under the National Credit Act 34 of 2005 (the Act) and is responsible for the regulation of the South African credit industry. It is tasked with carrying out education, research, policy development, registration of industry participants, investigation of complaints, and ensuring enforcement of the Act. The Act requires the Regulator to promote the development of an accessible credit market, particularly to address the needs of historically disadvantaged persons, low income persons, and remote, isolated or low density communities. The NCR is also tasked with the registration of credit providers, credit bureaux and debt counsellors; and enforcement of compliance with the Act.</p>
<p>Objectives of the NCA</p>
<p>&#8220;To promote a fair and non-discriminatory marketplace for access to consumer credit and for that purpose to provide for the general regulation of consumer credit and improved standards of consumer information; • to promote black economic empowerment and ownership within the consumer credit industry;<br/>• to prohibit certain unfair credit and market practices;<br/>• to promote responsible credit granting and use and for that purpose to prohibit reckless credit granting;<br/>• to provide for debt re-organisation in cases of over-indebtedness;<br/>• to regulate credit information;<br/>• to provide for registration of credit bureaux, credit providers and debt counselling services;<br/>• to establish national norms and standards relating to consumer credit;<br/>• to promote a consistent enforcement framework relating to consumer credit;<br/>• to establish the NCR and the National Consumer Tribunal;<br/>• to repeal the Usury Act, 1968, and the Credit Agreements Act, 1980; and to provide for related incidental matters.&#8221;<br/>Key features of the NCA<br/>Key features of the NCA<br/>• Language in credit agreements must be in simple and understandable;<br/>• Quotes must be given on all credit agreements, and are binding for 5 days;<br/>• Advertising and marketing must contain prescribed information on the cost of credit;<br/>• Credit sales at a person&#8217;s housed or work are strictly limited;<br/>• Reasons must be provided if a credit application is declined;<br/>• Automatic increases in credit limits are regulated;<br/>• Reckless lending is prohibited;<br/>• Interest and fees are regulated on all agreements, including micro-loans;<br/>• Credit Bureaux are regulated and consumers have the right to a free credit bureaux record;<br/>• Debt counselling is introduced, to enable restructuring of debts for over-indebted consumers.</p>
<p>When did the National Credit Act emanated into effect?</p>
<p>The Act came into effect on 1 June 2006. Certain sections became effective at a later date. Institutions:<br/>• The National Credit Regulator was established with effect from 1 June 2006.<br/>• The National Consumer Tribunal was established with effectuating from 1 September 2006. Registration:<br/>• Credit providers and credit bureaux had to register within 40 working days from 1 June 2006.<br/>• Debt Counsellors must file before 1 June 2007. Conduct &amp; compliance:<br/>• The sections on credit bureaux and credit information become effective on 1 September 2006.<br/>• The remaining compliance sections become effective on 1 June 2007. This includes the sections on disclosure, limits on interest &amp; fees, reckless lending and all related compliance requirements.<br/>• The sections on debt counselling &amp; debt restructuring become effective on 1 June 2007.</p>
<p>Which transactions fall under the Act?</p>
<p>• Loans and other impute from banks, including mortgages, overdrafts, credit cards, vehicle finance and any other personal finance;<br/>• Furniture finance, clothing accounts and any other type of credit from retailers;<br/>• Micro-loans and pawn transactions;<br/>• Any other type of credit or loan provided to a consumer.<br/>What is the role of the National Credit Regulator?<br/>What is the role of the National Credit Regulator?<br/>The National Credit Regulator has to<br/>• Register credit providers, credit bureaux and debt counsellors, and monitor the conduct of these parties;<br/>• Educate and create awareness of the protection which the Act offers;<br/>• Research the market and monitor access to credit and the cost of credit to identify factors that may undermine access to credit, competitiveness and consumer protection;<br/>• Advise government on policy and legislation;<br/>• Receive and investigate complaints and ensure that consumer rights are protected, and<br/>• Enforce the Act and take action against contravening institutions.</p>
<p>What is the National Consumer Tribunal?</p>
<p>The National Consumer Tribunal hears cases on non compliance with the Act, issues fines and provides redress to consumers. Consumers and providers may appeal to the Tribunal against any decision of the National Credit Regulator. The Tribunal is a separate institution that is independent of the NCR. The Tribunal consists of a Chairperson and at least 10 other members. 			    </p>

B/Ruptcy,and all other credit misdemenours are on your file for a reason, to allow prospective creditors/employers the ability to make the correct choice&#8230;.clear your okay,s**t your not. It works!! The old saying &#8216;if you cant do the time etc&#8230;&#8230;.&#8217;</p>

<p>It isn&#8217;t surprising that consumer credit services are a booming business today. The credit card industry along with a strong economy for a number of years made overuse of unsecured credit all to enticing form most people. With an economic downturn now full-blown, most are reeling nether massive financial debt. Consumer credit servicing are capitalizing on populate&#8217;s require to get out of debt.</p>

At times, this can be as much as 50% cancelled the original balance. The consumer pays monthly into an insured account. Money from the been is used to pay off creditors. With even the most sensible monthly plan, a consumer can be free of debt in 12 to 48 months at the most.</p>
<p>Consumer credit served are found everywhere these days, and the consumer has to be aware that many of them are not what they seem. Checking credentials, certifications and references is paramount to working with one that will have a full and complete program.				</p>

Can I apply again in a month?</strong><br/>I applied for a Chase Slate credit card a few weeks ago. I got a rejection letter from them yesterday. I was wondering if I should apply again in 30 days or give up on this card?  I really want this particular card and I&#8217;d like to have it by February at least.
